The petitioner apprehends his arrest in Mahila(Purnea) P.S. Case No.40 of 2018 registered under Sections 498A, 323 and other minor Sections of the Indian Penal Code.
The informant alleged that she performs in Orchestra of her brother-in-law, Birendra Paswan. She was married with Pramod Kumar Rajak but she left her house after knowing the fact that Pramod Kumar Rajak is impotent. While she was performing Orchestra, she came across with the petitioner, Basant Uraon who solemnised marriage with the informant in a temple. The informant further alleged that on account of kidney problem, she was admitted to hospital and her child was taken
Patna High Court Cr.Misc. No.79153 of 2018(3) dt.04-02-2019 2/2 out but the child could not survive. She further alleged that the petitioner did not provide her food and medicine. The learned counsel for the petitioner submits that the petitioner never solemnised marriage with the informant. According to the statement made in the First Information Report itself, the informant works in Orchestra.
Considering the aforesaid facts and nature of allegation made against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Purnea in connection with Mahila(Purnea) P.S. Case No.40 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
