This application, for grant of regular bail, arises out of Simari (Dera O.P.) Police Station Case No. 59 of 2023, registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2018. It is alleged that 108 bottles each contain 200 ML of Indian Made Foreign liquor has been recovered from the bag of the petitioner. The petitioner is in custody since 23.04.2023 and he has four criminal antecedent.

Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case.

Considering the fact and circumstances of the case, let the petitioner, named above, be released on bail after framing

Patna High Court CR. MISC. No.34243 of 2023(2) dt.23-05-2023 2/2 of charge on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Court-2, Buxar, in connection with Simari (Dera O.P.) Police Station Case No. 59 of 2023. The petitioner shall mark his presence in Simari (Dera O.P.) Police Station, Distt- Buxar on 1st Sunday of every month, failing which, the bail bonds of the petitioner would be cancelled.
