04-03-2015 Heard learned counsel for the petitioner and Mr. M. Rab, learned Addl. Public Prosecutor.

The petitioner, who is in custody since 04-09-2014 in Belaganj P.S. Case No. 29 of 2009 registered for the offence under Sections 147, 148, 149, 307 and 302 of the Indian Penal Code and Section 27 of the Arms Act, 1959, has prayed for grant of bail. Learned counsel for the petitioner submits that many of the accused persons, who were put on trial, have already been acquitted. He submits that there is general and omnibus allegation against the petitioner. It has been alleged that in the occurrence, the petitioner has also opened fire.

Learned Addl. Public Prosecutor has opposed the prayer for bail. He submits that the petitioner is an absconder.

Patna High Court Cr.Misc. No.49433 of 2014 (2) dt.04-03-2015 2/2 Keeping in view the fact that the petitioner is an absconder, I do not find any ground to extend the privilege of bail. The bail petition stands dismissed.
