JUSTICE SATYAVRAT VERMA ORAL ORDER 10-11-2025 Heard learned counsel for the appellants, learned Special P.P., Mr. Sadanand Paswan and learned counsel appearing on behalf of the informant, Mr. Santosh Kumar.

This is an appeal under Section 14(A)2 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the "SC/ST Act") against the refusal of prayer for anticipatory bail vide order dated 25.04.2024, passed by learned Special Judge S.C./S.T. (POA) Act, Samastipur in connection with Samastipur SC/ST P.S. Case No.12 of 2024, registered under Sections 147, 148, 149, 341, 323, 324, 354, 436, 380, 448 of the Indian Penal
Patna High Court CR. APP (SJ) No.2256 of 2024(4) dt.10-11-2025 2/3 Code and Sections 3(1)(r)(s)(w) and 3(2)(va) of the SC/ST Act.
3. Learned counsel appearing on behalf of the appellants submits that appellants are persons with clean antecedent. It is next submitted that Nitesh Kumar Singh along with eight others had approached this Court seeking anticipatory bail by filing Criminal Appeal (SJ) No.2025 of 2024 and the same was allowed by a learned co-ordinate Bench by order dated 04.12.2024, as such, the appellants seek anticipatory bail based on parity.
4. At this stage, the learned counsel appearing on behalf of the informant submits that parties have compromised and he has instructions not to oppose the appeal of the appellants.
5. Considering the submissions made by learned counsel appearing on behalf of the informant, let appellants, above named, in the event of their arrest or surrender before the learned Trial Court within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending in connection with Samastipur SC/ST P.S. Case No.12 of 2024,
Patna High Court CR. APP (SJ) No.2256 of 2024(4) dt.10-11-2025 3/3 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
6. Accordingly, the impugned order is set aside and this appeal stands allowed.
