JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 28.08.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 324, 307 and 302 of the Indian Penal Code and Section 27 of the arms Act.

It is alleged that seven accused persons including the petitioner surrounded the informant when firearm injury was caused by Arun Paswan, Vikash Paswan and Mintu Paswan, subsequently, the informant succumbed to the injuries. It is submitted by learned counsel for the petitioner that the accusation of causing firearm injury is not against the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named

Patna High Court Cr.Misc. No.7257 of 2015 (2) dt.02-03-2015 2/2 petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Chandauti P.S. Case No. 245 of 2010. Since the case was registered in the year 2002 and the petitioner has been apprehended in the year 2014, learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions.
