Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Gadhpura P.S. Case No. 36 of 2022 registered for the offence under Sections 461 and 379 of the Indian Penal Code. As per the prosecution case, the F.I.R. has been filed against unknown accused persons in which allegation of theft of jewelry and silver were subject matter of theft. Learned counsel for the petitioner submits that the petitioner is in custody since 09.11.2022 and he is quite innocent and has committed no offence.

Patna High Court CR. MISC. No.35032 of 2023(2) dt.12-07-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the fact that the similarly situated accused person has been granted bail by this Court vide order dated 21.02.2023 in Cr. Misc. No. 56988 of 2022(Annexure-II), this application for regular bail is allowed. Let the petitioner, above named, be released on bail after completing 9 months in custody and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Begusarai/concerned Court below in connection with Gadhpura P.S. Case No. 36 of 2022.

The petitioner will mark his attendance at the Gadhpura Police Station, Begusarai on each Sunday of each month.

Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner. This application for regular bail stands allowed. (Sandeep Kumar, J) Shishir/- U T
