This is a petition for grant of regular bail in a case under Sections 420, 406 and 120B of the Indian Penal Code. It is alleged that petitioner has taken Rs.18,00,000/- from the informant in the name of Matajee for constructing the cow-shed by cheating him.

It is submitted on behalf of the petitioner that the petitioner is the driver by profession and neither he met the informant nor he knew him. It is further submitted that whole amount has been given to Hulashi Pathak treasurer of the Asshram and the husband of Matajee. The informant has not given single paisa to the petitioner. The petitioner was also not present at that place where the informant has given the whole amount. It is also submitted that whole allegation about the

Patna High Court Cr.Misc. No.14634 of 2015 (3) dt.11-08-2015 faradism and cheating is on Matajee and her husband Hulashi Pathak.

Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Kuchaikote P.
