2. The petitioner apprehends his arrest in connection with Dumariyaghat P,S. Case No.344 of 2025, FIR dated 08.12.2025, registered for the offence punishable under Sections 303(2), 111, 112, 313, 317(4), 317(5), 3(5) of the Bharatiya Nyaya Sanhita.
3. It is alleged that the informant's truck bearing Registration No.BR-06GD-9624 was stolen by unknown thieves on the alleged date of occurrence. The driver of the truck, namely, Kapildeo Ray, had halted for dinner at a dhaba and upon returning the said truck was found missing. Despite search, the truck could not be traced and its GPS was also found non-functional.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.35303 of 2026(2) dt.27-05-2026 2/3 petitioner is innocent and has been falsely implicated in the present case. It is submitted that nothing has been recovered from the conscious possession of the petitioner and there is no specific allegation attributed against him in the entire FIR. It is further submitted that the name of the petitioner has transpired during the course of investigation on the basis of the confessional statements of co-accused persons, namely, Bhushan Kumar and Bikau Kumar, who were apprehended by the police. The petitioner is in no way connected with the seized truck bearing Registration No. BR-06GD-9624. Lastly, it is submitted that the petitioner has three criminal antecedents.
5. On the other hand, the learned APP for the State has opposed the prayer for bail of the petitioner.

Having heard learned counsel for the parties and considering the facts that nothing incriminating has been recovered from the constructive possession of the petitioner and his name has transpired in this case on the basis of the confessional statement of the co-accused, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount

No.35303 of 2026(2) dt.27-05-2026 3/3 each to the satisfaction of the learned Sessions Judge, East Champaran at Motihari/Successor Court in connection with Dumariyaghat P.S. Case No.344 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS as well as the following conditions:
(i) One of the bailors should be the family member/relative/known of the petitioner(s) who shall provide official document/ personal affidavit to show his/her bona fide; (ii) the petitioner(s) shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her/their bail bond by the Trial Court itself; (iii) the petitioner(s) shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner(s) shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of their bail bonds. (Ajit Kumar, J) rishi/- U T
