Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Obra P.S. Case No. 30 of 2021, registered for the offence punishable under Section 302/34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with two others indiscriminately assaulted the brother of informant (deceased) by means of lathi, danda, as a result of which during course of treatment he died.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case due to village politics. There is general and omnibus allegation and no specific

Learned APP however, vehemently opposed the prayer for bail and submitted that this petitioner along with two others assaulted the deceased causing his death. Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
