JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2020 Heard Mr. Kumar Ravish, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in connection with Special Case No. 450 of 2020 arising out of Araria (Bairgachhi) P.S. Case No. 405 of 2020, dated 29.05.2020, instituted for the offences under Sections 30(a), 36 and 41 of the Bihar Prohibition and Excise Act, 2016.

814.500 litres of liquor is said to have been recovered from a pickup van which is owned by the petitioner and at the relevant time, he was driving that vehicle.

Patna High Court CR. MISC. No.33403 of 2020(2) dt.14-12-2020 2/2 Learned counsel for the petitioner has submitted that the petitioner is in custody since 30.05.2020 and is a person of clean antecedents.

Regard being had to the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-CumSpecial Judge, Araria in connection with Special Case No. 450 of 2020 arising out of Araria (Bairgachhi) P.S. Case No. 405 of 2020.
