JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-03-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner being husband of the complainant is languishing in jail custody since 16-12-2014 in a case in which, cognizance has been taken for the offence punishable under Section-498A of the Indian Penal Code.

From perusal of the complaint petition, it would appear that no specific overt act has been attributed against the petitioner and the prayer for bail of the petitioner was rejected by learned court below only because he refused to lead his married life with the complainant.

Patna High Court Cr.Misc. No.10065 of 2015 (2) dt.12-03-2015 2/2 Accordingly the petitioner named-above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Complaint Case No. 766 C of 2013 to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara.
