JUSTICE AMARESH KUMAR LAL ORAL ORDER 14-01-2015 Heard learned counsel for the petitioners and the State. The petitioners are in custody for the offences punishable under Sections 323, 406, 498(A) and 304(B) of the Indian Penal Code.

It is submitted that the petitioners are mother-in-law and brother-in-law of the deceased. It is further submitted that the deceased died in her father's house and it is a case of the informant itself that the marriage of the deceased was performed nine years ago and as such Section 304(B) of the Indian Penal Code is not applicable in this case. The petitioners have got no criminal antecedent.

Considering the facts and circumstances of the case, let

No.49023 of 2014 (2) dt.14-01-2015 2/2 the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Noor Sultan, Judicial Magistrate, 1st Class, Vaishali at Hajipur in Goural P.S.Case No. 275 of 2004 with the following conditions:

(1) One of the bailors will be the close relative of the petitioners.

(2) The petitioners will not indulge in similar or in any other offence.

(3) The petitioners will be well represented in the court.

(4) In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the court concerned. (Amaresh Kumar Lal, J) singh/- U T
