JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2019 This is an application for grant of anticipatory bail in connection with Samastipur (Mufassil) P.S. Case No. 62 of 2017, disclosing offences under Sections 304(B)/34 of the Indian Penal Code.

Allegation against the petitioner, who happens to be the husband of the deceased, is of committing dowry death of the deceased.

Submission of learned counsel for the petitioner is that several witnesses in several paragraphs of the case diary have stated that the deceased was used to talk with her brotherin-law (Bahnoi), which was objected by the petitioner and due to that she has committed suicide.

Heard learned A.P.P. also, who opposed the prayer for

No.78386 of 2018(5) dt.28-02-2019 2/2 anticipatory bail of the petitioner stating that the petitioner is husband of the deceased and the family members of the deceased have supported the prosecution case. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-5, Samastipur, in connection with Samastipur (Mufassil) P.S. Case No. 62 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
