JUSTICE RAVI RANJAN ORAL ORDER 03-03-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in a case registered under Sections 457, 380 and 411 of the Indian Penal Code. It has been submitted on behalf of the petitioners that as per the allegation set out in the first information report, petitioners were apprehended immediately after occurrence while they were trying to escape and it is highly improbable that they would have found time to hide the DVD player in the house and would again come back only to be apprehended by the persons of the locality. Petitioners claim that they do not have any criminal antecedent. It is also submitted that petitioner no.2 is the father in law of

Having regard to the facts and the circumstances of the case, the petitioners, Shiva Prasad and Ram Nath Mahto are directed to be released on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M. Saran at Chapra in connection with Chapra Town P.S. Case No.281/14 with a condition that one of the bailors of the petitioners must be the close relative of their family member, who will file affidavit before the court below giving full genealogy showing his or her relationship with the petitioners.
