The petitioner is apprehending his arrest in connection with Fatehpur P.S.Case no.214 of 2018 , registered for offences punishable under Sections 302, 201, 34 of the Indian Penal Code.

Allegation as per FIR is that one dead boy of a lady and a child was found in a well and the FIR was lodged by the Chaukidar against the known persons. It appears that during the course of investigation it was found that the dead body of the lady was of second wife of one Sanjeev and the petitioner happens to be father-in-law of first wife of Sanjeev. Submission of the learned counsel for the petitioner is that except suspicion there is absolutely nothing against the petitioner and he has been falsely implicated in this case.

Patna High Court Cr.Misc. No.78989 of 2018(3) dt.22-01-2019 2/2 Heard learned A.P.P. who has opposed the prayer for bail on the ground that the materials collected during the coruse of investigation discloses that Sanjeev called the deceased on phone and thereafter while she was going along with her child they were killed and the petitioner happens to be the father-inlaw of the first wife of Sanjeev. . Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Fatehpur P.S.Case No.214 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case. .. With the aforesaid observation, this application is allowed.
