JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2019 This is an application for grant of anticipatory bail in connection with Rasulpur P.S. Case No. 120 of 2018, disclosing offences under Sections 30, 38, 41 of the Bihar Prohibition and Excise Act.

Allegation is of recovery of 8 liters liquor from the place of occurrence and the petitioner was seen fleeing away from the place of occurrence.

Submission of learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioner and he has made accused only on the basis of suspicion. Though, he is accused in one more case, but not of the similar type.

Having heard both sides, considering the above

Patna High Court Cr.Misc. No.78459 of 2018(2) dt.09-01-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 6th A.D.J., Saran at Chapra, in connection with Rasulpur P.S.
