The petitioners apprehend their arrest in connection with Nawada Mahila P.S. Case No. 03 of 2019, registered for the offences punishable under Sections 341, 342, 323, 354 (B),427, 506,34 of the Indian Penal Code.

Four accused persons including the petitioners are said to have intruded in the house of the informant and tried to drag her and on protest by her and her mother they assaulted the informant and her mother by means of butt of rifle. It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. Petitioners

Patna High Court CR. MISC. No.31071 of 2019(2) dt.09-05-2019 2/2 have no concern with the aforesaid occurrence. They have been falsely implicated in this case due to land dispute. Petitioners happen to be the neighbour of the informant. Allegation levelled against the petitioners is not specific rather general and omnibus in nature. Though, one grievous injury is found on the person of the mother of the informant but assailant of the injury is not ascertained.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Nawada Mahila P.S. Case No.03 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
