JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be mother-in-law of the deceased and according to the prosecution case itself, the informant came at the house of the petitioner on the information given by the petitioner and furthermore, it is an admitted position that when the informant reached at the house of the petitioner, the deceased was alive and she was taken to hospital by the informant as well as petitioner. Furthermore, the written report of the informant reflects that at the time of alleged occurrence, the deceased was pregnant and when she was brought to hospital, the doctor noticed that child of the deceased had already died in her womb, as a result of which, the condition of the deceased started deteriorating
Patna High Court Cr.Misc. No.708 of 2016 (2) dt.08-01-2016 2/2 and she died.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Araria in connection with Jogbani ( Bathnaha) P.S.Case No. 71 of 2015.
