2. The petitioner seeks pre-arrest bail in connection with Udakishunganj P.S. Case No.51 of 2024 dated 14.02.2024 registered for the offence(s) punishable under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.

3. The allegation is of recovery of 36.750 litres of English wine from the Scorpio Vehicle bearing Registration No.BR-11PC-4188.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in the case. He has no concern either with the seized liquor or trade of liquor in any manner. It is further submitted that the petitioner is owner of the vehicle, however, he was not present

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

Having considered the rival submissions made on behalf of the parties and nature of allegation against the petitioner, the petitioner, above named is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail-bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-V-cum-Special Judge Excise Act-I, Madhepura in connection with Udakishunganj P.S. Case No. 51 of 2024, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

7. The bail application stands disposed of.
