2. The petitioners have preferred this application for grant of regular bail in connection with Special Excise P.S. Case No. 739 of 2025 arising out of Rani Talab P.S. Case No. 102 of 2025 dated 08.03.2025 registered for the offence/s punishable u/ss 126(2), 115(2), 109, 132, 262, 263, 324(4), 324(5), 352, 351(2), 351(3) read with section 3(5) of the BNS and section 30(a), 45 of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, total 10 litres of

Patna High Court CR. MISC. No.34434 of 2025(2) dt.03-07-2025 2/3 illicit country made liquor was recovered from the back of the shop of the co-accused Arun Tanti and 30 litres of country made liquor was recovered from the house of the co-accused Kariman Manjhi.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioners have no concern with the alleged recovery. The name of the petitioner has sprung up on mere suspicion. Nothing has been recovered from the conscious possession of the petitioner. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 09.03.2025. Similarly situated co-accused has already been granted bail by this court vide order dated 29.04.2025 passed in Cr. Misc. No. 25626 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty

Patna High Court CR. MISC. No.34434 of 2025(2) dt.03-07-2025 3/3 Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Danapur, Patna in connection with Special Excise P.S. Case No. 739 of 2025 arising out of Rani Talab P.S. Case No. 102 of 2025.
