The petitioner seeks regular bail in a case under Sections 414/34 of the Indian Penal Code.
The police apprehended Niraj Kumar Singh and the petitioner Vinod Kushwaha. From the possession of the petitioner, one mobile and one Bajaj Platina motorcycle were recovered. It is submitted that the owner book of the recovered motorcycle is in the name of Ram Bachan Kushwaha, the father of the petitioner, which would appear from Annexure-2. Therefore, no stolen motorcycle is recovered from the possession of the petitioner.
Considering the fact that the motorcycle, which was recovered from the possession of the petitioner, is owned by the
Patna High Court Cr.Misc. No.8620 of 2015 (2) dt.02-03-2015 2/2 father of the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in Gopalganj (Town) P.S. Case No. 540 of 2014.
