1. Heard learned counsel for the petitioner Ms. Rashmi Jha, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant Mr. Bimilesh Kumar Pandey.

2. The petitioner apprehends his arrest in connection with Inarwa P.S. Case No.10/2025, registered for the offences punishable under Sections 126(2), 115(2), 118(2), 76, 303(2), 351(2), 352, 3(5) of the B.N.S.S.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and on account of dispute relating to drain, the occurrence is alleged to have taken place on 24.01.2025 when petitioner is alleged to have assaulted Asahab Alam by bhala causing injury on eye.

It is next submitted that though there is allegation of assault but then the blow was not repeated and on issue of dispute relating to drain, an altercation had taken place in which both side assaulted each other.

5. Learned A.P.P. for the State along with learned counsel appearing on behalf of the informant opposes the prayer for anticipatory bail of the petitioner. The learned counsel appearing on behalf of the informant submits that there is specific allegation against this petitioner of assaulting Asahab Alam by bhala causing injury on eye. It is also submitted that eye is vital part of the body and the injury has been opined to be grievous by the doctor.

6. Considering the submissions made by the learned counsel appearing on behalf of the informant, the court is not inclined to extend the privilege of anticipatory bail to the petitioner.

7. The anticipatory bail application of the petitioner is rejected.
