JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-03-2021 As prayed for, let the learned counsel for the petitioners remove the defect(s), as pointed out by the office vide it's note, dated 27.11.2020, within four weeks of starting of the Court proceeding in physical mode properly. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the state.
The petitioners seek pre-arrest bail in connection with Vaishali (Belsar O.P.) P.S. Case No. 212 of 2020, pending in the Court of the Chief Judicial Magistrate, Vaishali at Hajipur, for the offence alleged under Section 392 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that the petitioners are not named in the first information report as on the basis of fardbeyan of Sujit Kumar Vaishali (Belsar O.P.) P.S. Case No. 212 of 2020 was instituted
Patna High Court CR. MISC. No.32195 of 2020(2) dt.05-03-2021 2/2 on 26.06.2020 against unknown. In course of investigation the names of the petitioners have surfaced in the confessional statement of co-accused, Suraj Kumar, who is co-villager of the petitioners. The co-accused, due to inimical term, has disclosed the names of the petitioners. The first information report indicates that the informant has detailed the physique of the culprits claiming that he could identify them in the test identification parade.
Having regard to the facts and circumstances of the case, I am not inclined to grant the privilege of pre-arrest bail to the petitioners. The prayer for pre-arrest bail is rejected. The petitioners are directed to surrender before the Court below and seek regular bail, which will be considered on its own merit and without being prejudiced of this order.
