1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 109(1), 126(2), 115(2), 117(2), 303(2), 352, 351(2), 3(5) of BNS.
3. Learned counsel for the petitioners at the outset seeks permission to withdraw the anticipatory bail application with respect to petitioner no.1, namely, Sachin Kumar, who was arrested during pendency of the instant anticipatory bail application.

Learned counsel for the petitioners submits that petitioner no.2 and 3 are persons with clean antecedent and the informant alleges that accused persons came and Sachin along with Nitish assaulted his father by farsha causing injury on head, thereafter they again assaulted his father by rod causing fracture of shoulder, further Ram Prasad and Bilat assaulted his younger brother by an iron rod causing fracture of shoulder and waist with cut injury on hand, thereafter Chandan assaulted his father by rod on head causing injury and Kranti Devi snatched gold chain from the neck of the informant and took Rs.10,000/- and valuables from a box.
6. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that even presuming what has been alleged is true without admitting, then the petitioners are alleged to have assaulted the younger brother of the petitioner namely, Sunil and from perusal of the order impugned, it would manifest that Sunil has suffered simple injury, which amply demonstrates that petitioners never had any intention of committing a serious occurrence.
7. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Vidyapati Nagar P.S. Case No.161/2024, subject to the conditions as laid down under Section 482 (2) of the B.N.S.S.
