2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Mahila Bagaha P.S. Case No. 24 of 2025 instituted for the offence under Sections 69, 89, 115(2), 352 , 351(2) and 3(5) of BNS.
3. The case of the prosecution is that one Rajbahadur Ram has established forceful physical relationship with the informant on the false promise of marriage. It is alleged that when the informant pressurized him for marriage, his family members including the petitioner who is the uncle of Rajbahadur Ram assured her of the marriage and on their
Patna High Court CR. MISC. No.34167 of 2026(2) dt.22-06-2026 2/3 assurance, she started living with Rajbahadur Ram. It is alleged that all the accused persons including the petitioner have demanded Rs. 3,00,000/- and a bike.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel has submitted that the petitioner is the uncle and main thrust of allegation is against Rajbahadur Ram who has established forceful physical relationship on the false promise of marriage. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent.
5. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Mahila P.S. Case No. 24 of 2025, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand)with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge 1st
