The petitioner apprehends his arrest in Pipra P.S. case No. 73 of 2017 registered under Section 392 of the Indian Penal Code.
The informant lodged the case for robbing of cash and mobile from his possession.
The learned counsel for the petitioner submits that petitioner is not named in the FIR. The name of petitioner figured on the basis of the fact that one looted mobile was recovered from the possession of the petitioner in connection with Kotwa P.S. case No. 88 of 2017. It is submitted that coaccused, Umesh Yadav, handed over the looted mobile to the petitioner but considering the fact that one of the looted mobiles of the present case was recovered from the possession of the
Patna High Court Cr.Misc. No.80107 of 2018(2) dt.16-01-2019 2/2 petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
