The petitioner seeks bail in connection with Khusrupur P.S. Case No. 401 of 2024 instituted for the offence under Sections 80, 103(1), 238, 61(2) of the Bharatiya Nyaya Sanhita, 2023.

Prosecution case in short is that daughter of the informant was done to death by her in-laws due to nonfulfillment of the demand of dowry. 4.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23-03-2025. Petitioner bears no criminal antecedent, as per disclosure made in

Patna High Court CR. MISC. No.33431 of 2025(4) dt.11-07-2025 2/3 paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the FIR. Petitioner is the cousin father-in-law of the deceased. Husband of the deceased is already in custody. There is no specific allegation against the petitioner, rather allegation is general and omnibus in nature. Learned counsel for the petitioner submits that during course of investigation, it has appeared that specific allegation is against co-accused, namely, Sunil & Binod. Charge sheet is submitted in this case. Father-in-law of the deceased has been enlarged on bail by this Court vide order dated 21-03-2025, passed in Cr. Misc. No. 16433 of 2025.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of

Patna High Court CR. MISC. No.33431 of 2025(4) dt.11-07-2025 3/3 Court below/concerned Court in connection with Khusrupur P.S. Case No. 401 of 2024.
