The petitioner is facing accusation punishable under sections 457, 380 and 411 IPC vide Bhagwan Bazar P.S. Case No. 135/2014 and seeks bail.

A theft was committed in the shop of the informant and several electronic items kept therein were stolen away. On secret information the house of the petitioner was searched on the same day. One mobile of the given description was recovered. The contention of the petitioner is that he is in custody since 20.08.2014 and there is no criminal antecedent against him. The petitioner has sought to explain the circumstances under which seizure was made.

No.48314 of 2014 (3) dt.03-03-2015 2 / 2 Considering the fact that the petitioner abovenamed has no criminal antecedent and is languishing in jail since 20.08.2014, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Saran in connection with Bhagwan Bazar P.S. Case No. 135/14 on condition that one of the bailor shall be own/close family member of the petitioner. In the event of framing of charge the petitioner shall appear in person on all dates fixed at trial. In case of default in doing so on two consecutive dates the trial court shall cancel the bail bonds of the petitioner and secure his arrest in accordance with law.
