The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 307, 341, 323, 324 and 34 of the Indian Penal Code.

As per the prosecution case, it is stated by the informant that the daughter in law and grand son assaulted the deceased (informant's son) as a result of which he fell down unconscious and died in course of treatment in the hospital. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He happens to be the son of the deceased. The informant is not an eye witness to the occurrence. Coaccused mother of the petitioner namely Chanda Devi has been enlarged on bail vide

Patna High Court CR. MISC. No.44432 of 2021(4) dt.24-02-2022 2/2 order dated 3.6.2020 passed in Cr. Misc. no.16693 of 2020. The petitioner is in custody since 4.4.2021 and has no criminal antecedent. Chargesheet has been submitted in the case under section 304 of the Indian Penal Code.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 10 months and chargesheet having been submitted under section 304 of the Indian Penal Code, the Court directs the petitioner to be enlarged on bail in connection with Kudhni P.S. Case no. 842 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. - 1st West Muzaffarpur, District Muzaffarpur.
