2. The petitioner seeks bail in connection with Barhara P.S. Case No. 45 of 2024 instituted for the offences under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code.

3. Earlier vide order dated 30.10.2024 passed in Cr. Misc. No. 74508 of 2024, the prayer for grant of anticipatory bail to the petitioner was rejected.

4. Prosecution story, in short, is that on the alleged date and time of occurrence, all the accused persons including the petitioner surrounded the informant and when the informant objected then all the accused persons assaulted him. It is further alleged that this petitioner along with other co-accused caught

Patna High Court CR. MISC. No.34728 of 2025(2) dt.19-06-2025 2/3 hold of the informant and co-accused Ajit Turha assaulted the informant on his head by means of iron rod. In the meantime, when the uncle of the informant came to rescue, the accused persons also assaulted him. It is further alleged that petitioner along with other co-accused caught hold the uncle of the informant and co-accused Golu Turha assaulted him on his head using sharp weapon.

5. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel for the petitioner submitted that general and omnibus allegation has been made against the petitioner. No specific allegation of assault is made against this petitioner. The only specific allegation against the petitioner is of catching hold of the informant and his uncle. The specific allegation of assault is attributed to Ajit Turha and Golu Turha. Learned counsel further submitted that there is case and counter-case between the parties. It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.03.2025 and has no criminal antecedent.

6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

7. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.34728 of 2025(2) dt.19-06-2025 3/3 of the case as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

8. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Barhara P.S. Case No. 45 of 2024.
