The petitioner seeks bail in Karakat P.S. Case No. 208 of 2014, registered for the offences punishable under Sections 341, 323, 324, 302 and 34 of the Indian Penal Code. Prayer for bail of the petitioner was rejected earlier vide order dated 06.05.2015.
It is submitted that the trial has not yet been concluded. Not even single witness has been examined by the trial court. The petitioner is alleged to have pierced Bhala, consequently Sriniwas Singh died.
Considering the nature of allegation, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
Patna High Court Cr.Misc. No.3220 of 2016 (3) dt.29-06-2016 2/2 The learned Additional Sessions Judge III, Rohtas at Sasaram is directed to hold the trial on day-to-day basis and conclude the same within nine months from the date of receipt of this order, if the trial is not concluded the petitioner may renew his prayer for bail firstly in the court below.
