The petitioner is apprehending his arrest in connection with Bahadurpur P.S. Case No.14 of 2018 (G.O. Case No.36/2018) registered under Sections 30(a), 34, 36, 38, 41 of Bihar Excise and Prohibition Act, 2016. Allegation against the petitioner as per the FIR is that 240 bottles of liquor of 375 ml has been recovered from Bhusha ghar. On alarm raised, petitioner was fleeing away from the place of occurrence.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and has been falsely implicated in this case. Nothing has been recovered from his

Patna High Court CR. MISC. No.80711 of 2018(3) dt.15-04-2019 2/2 possession and from his house and other accused persons having similarly situated has been granted bail by this Court as stated in para-10 of the petition.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs.25,000/- (Rupees Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge 4th-cum-Special Judge, Darbhanga in connection with Bahadurpur P.S. Case No.14 of 2018 (G.O. Case No.36/2018), subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
