Petitioner seeks bail in a case under Section 376 IPC. The father of the victim girl alleged that the petitioner committed rape on her minor daughter. The statement of the victim was recorded under section 164 Cr.P.C, in which she has categorically stated that the petitioner committed unnatural offence with her.
Learned counsel for the petitioner submits that the doctor did not find any injury. The petitioner has been arrested and he has also filed a complaint case against the informant on 2.1.2015.
It appears that the victim, who is minor, has made specific allegation that the petitioner took her in a lonely place and committed unnatural offence with her but surprisingly, the doctor gave report that no rape was committed with the victim. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail and accordingly, the same is rejected.
