The petitioner, who is in custody since 17.08.2019 and is the husband of the deceased, seeks bail in connection with Sessions Trial No. 587/2019 arising out of Khodawand Pur P.S. Case No. 165 of 2019 instituted for the offences under Sections 120(B)/302/201/34 of the Indian Penal Code.
The dead body of the deceased was found from a water-body with marks of violence on her person. There is a past history of domestic violence against her. The deceased
Patna High Court CR. MISC. No.33551 of 2020(3) dt.12-01-2021 2/2 had gone to stay with the petitioner only under the directions of the Court. Later she was not to be found and on search her dead body was recovered.
Considering the aforesaid background and the attending circumstances as well as the materials collected during the course of investigation, I am not inclined to grant bail to the petitioner.
The prayer for bail is rejected.
