JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Singhwara P.S. Case No. 197 of 2015, registered under Sections 147, 148, 149, 448, 341, 323, 307, 427, 380, 504 and 506 of the Indian Penal Code.

The accusation is that petitioner along with seven named in the F.I.R. reached at the door of the informant and cause injury by means of sword at the head of the informant. Learned counsel appearing on behalf of the petitioner submits that while there is specific allegation of causing injury at the head of the informant by means of sword, but it would appear from the injury report of the informant

Patna High Court Cr.Misc. No.2394 of 2016 (3) dt.15-03-2016 2/2 Saukat Ali vide para 17 of the case diary that the injuries are said to be caused by hard and blunt substance. Moreover, after investigation, Police has submitted chargesheet in bailable sections. The petitioner is in custody since 26.11.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga in connection with Singhwara P.S. Case No. 197 of 2015. Out of two sureties, one surety must be parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
