JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-07-2024 The petitioner has complained of disobedience of the order of this Court dated 20.06.2022 passed in CWJC No. 21042 of 2018, whereby and whereunder the opposite parties were directed to process the case of the deceased father of the petitioner, who had superannuated on

Patna High Court MJC No.1490 of 2023(4) dt.26-07-2024 2/3 30.04.2002, for payment of leave encashment amount as also the outstanding amount of G.P.F. 2.

The learned counsel for the opposite parties has referred to a show cause filed on behalf of the opposite parties no. 2, 3 and 6 on 17.02.2024, paragraphs no. 10 to 12 whereof states that a sum of Rs. 46,920/- has been paid to the petitioner vide bill dated 02.02.2024, after assuming that maximum leave is available in the account of the deceased employee and further outstanding amount of Rs. 7,614/- has been paid on the head of G.P.F., including interest, to the petitioner vide bill dated 07.02.2024, apart from request having been made to the Principal Secretary/Secretary, Water Resources Department, Ranchi, Jharkhand and Waterways Division, Garhwa, Jharkhand to make necessary payment of the outstanding G.P.F. amount, from their end, in case any such amount is outstanding for payment. In fact the opposite parties have also referred to the supplementary show cause filed on behalf of the opposite parties no. 1 to 5 on 07.02.2024, wherein it has been stated in paragraphs no. 14 and 15 that a sum of Rs. 7,614/-

Patna High Court MJC No.1490 of 2023(4) dt.26-07-2024 3/3 has been paid to the petitioner on the head of G.P.F. apart from a sum of Rs. 46,920/- having been paid to the petitioner on account of leave encashment of 300 days. Thus, it is submitted by the learned counsel for the opposite parties that the order of this Court dated 20.06.2022 has stood complied with. 3.

This Court finds that the aforesaid aspect of the matter has not been controverted by the petitioner inasmuch as no rejoinder has been filed to the aforesaid show cause/supplementary show cause filed on behalf of the opposite parties, thus this Court is satisfied that the order of this Court dated 20.06.2022 passed in CWJC No. 21042 of 2018 has been complied with. Hence, the present petition stands disposed off, while reserving liberty to the petitioner to approach the authorities of the Government of Jharkhand, for redressal of his subsisting grievances, if any, qua them.
