2. The petitioner has prayed for bail in connection with Cyber (Vaishali) P.S. Case No. 68 of 2024 registered for the offence punishable under Sections 318(2), 303(2), 318(4), 319(2), 336(2), 336(3), 340(2), 61(2), 3(5) of the BNS and Sections 66B, 66c, 66D of the I.T. Act.
3. As per the prosecution case, the police located two mobile numbers used in cyber fraud and a raid was conducted and this petitioner along with other co-accused persons were apprehended by the police. It is also alleged that from the
Patna High Court CR. MISC. No.32640 of 2025(2) dt.22-05-2025 2/3 possession of this petitioner, two mobile phones, Aadhar Card, ATM card etc. was recovered.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He submits that nothing incriminating articles have been recovered from the conscious possession of the petitioner. He also submits that other co-accused persons namely, Ravi Raj and Rohit Raj have been granted bail vide order dated 02.05.2025 in Cr. Misc. No. 23476 of 2025 and Cr. Misc No. 23858 of 2025 respectively. It has also been submitted that a statement has been made in para 3 of the petition that petitioner has no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 22.12.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned
