JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and it appears that name of petitioner came in confessional statement of co-accused and after that petitioner was arrested and he, too, made his confessional statement. Except the aforesaid material, there appears to be nothing against the petitioner. Moreover, one co-accused, Lohar Paswan @ Sohar Paswan, in whose confessional statement the name of petitioner came in this case, has already been granted privilege of bail by a co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.3568 of 2016 (2) dt.04-02-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 75 of 2015.
