This application for anticipatory bail, arises out of Bhabua Police Station Case No. 767 of 2018, disclosing offences punishable under Sections 341, 504, 506, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is the uncle of the informant. There is land dispute between the parties, which is apparent from the first information report. The petitioner is said to have opened fire with intention to kill the informant, but apparently he did not receive any injury.

Learned counsel for the petitioner has submitted that the registration of criminal case is manifest and a similar case

Patna High Court Cr.Misc. No.80260 of 2018(25) dt.22-01-2019 2/2 was earlier also registered by the family of the informant. Considering the submission, as above, this application is allowed.

Let the petitioner, above-named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each to the satisfaction of the learned C.J.M. Kaimur at Bhabua in connection with Bhabua Police Station Case No. 767 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
