JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-02-2021 Heard Mr. Mukesh Kumar Singh, learned counsel for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Chapra (Muffasil) P.S. Case No. 204 of 2020, dated 20.05.2020, instituted for the offences under Sections 273 and 34 of the Indian Penal Code and Sections 30(a), 36, 37, 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
Patna High Court CR. MISC. No.32517 of 2020(2) dt.12-02-2021 2/2 50 litres of country made liquor and 650 litres of liquid jaggery and mahuwa flower is said to have been recovered from an open place. The prosecution of the petitioner is on the basis of confession of arrested accused persons.
Regard being had to the fact that there is no recovery from the possession of the petitioner and that he does not have criminal antecedents and is a person of seventy years of age, he, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge, Excise, Saran, Chapra, in connection with Chapra (Muffasil) P.S. Case No. 204 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
