JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Complaint Case No.676/2015, which was referred under Section 156(3) Cr.P.C.for institution of F.I.R., pursuant to which Raghunathpur P.S. Case No.52/2015 was registered under Sections 364, 366/34 of the Indian Penal Code.

The accusation is that petitioner along with eleven others named in the complaint petition, which is the basis of F.I.R, came in the house of complainant on 11.03.2015 on the pretext of purchasing the Saree, her married daughter Saroj Devi was accompanied by them.

At that time she was also taking cash of Rs. 20,000/- but she did not return. When she tried to talk with mobile of Saroj Devi, the

Patna High Court Cr.Misc. No.1552 of 2016 (3) dt.23-02-2016 mobile was snatched by this petitioner and threatening was given to kill Saroj Devi. The complainant raised suspicion that her daughter was kidnapped for the purpose of marriage. Learned counsel for the petitioner submits that in fact the neighbour of the informant is relative of the petitioner and there is land dispute between the informant and neighbour. The further submission is that the petitioner and his entire family have been falsely implicated in the present case. The petitioner has no criminal antecedent and is in custody since 04.06.2015 and charge sheet has already been submitted.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Siwan in connection with Raghunathpur P.S.
