JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-07-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as Mr. Pranav Kumar, learned APP for the State.

The petitioner apprehends his arrest in connection with Raniganj P.S. Case No. 359 of 2019, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code. As per Fir, the sister of the informant was murdered by fourteen named accused persons and her dead body was concealed. Learned counsel for the petitioner has submitted that the petitioner is not amongst the fourteen persons named in the FIR against whom there was allegation of killing the deceased. He has further submitted that the informant who is brother of the deceased and even husband of the deceased had sworn an affidavit stating

He has submitted further that the name of the petitioner was added during course of investigation on the basis of a video clip. He submitted further that the other persons whose names were implicated on the basis of same video clip have been granted anticipatory bail by the coordinate Bench in Cr. Misc No. 33453 of 2020.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Araria in connection with Raniganj P.S. Case No. 359 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
