2. This application for anticipatory bail arises out of Hathauri P.S. Case No. 12 of 2026 for the offences punishable under Sections 80, 238 and 61(2) of the B.N.S.
3. As per the allegation, petitioners along with coaccused person, had killed the daughter of the informant within seven years of marriage for non fulfillment of dowry demand. It has further been alleged that the dead body was cremated without informing the informant's side.
4. Learned senior counsel for the petitioners has submitted that petitioners are mother-in-law and father-in-law
Patna High Court CR. MISC. No.33895 of 2026(3) dt.24-07-2026 2/3 respectively, of the deceased and there is general and omnibus allegation against the petitioners. It has further been submitted that the petitioners used to reside separately in mess and residence from the deceased and her husband and had got no concern with their day to day affairs. It has further been submitted that during the entire investigation none of the witness have specifically stated against the petitioners. It has further been submitted that the husband of the deceased is in judicial custody. It has further been submitted that petitioners are old and infirm. It has lastly been submitted that the petitioners have got no criminal antecedent.
5. Learned counsel for the State opposed the prayer of anticipatory bail of the petitioners.
6. Heard the parties and perused the record. Considering the facts and circumstances as well as the fact that the husband of the deceased is in custody, let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, (East), Muzaffarpur, in connection with Hathauri P.S. Case No. 12 of 2026, subject to the conditions as
