Mr.APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-03-2021 Heard Mr. Vasant Vikas, learned counsel for the petitioners and Mr. Sanjay Kumar Tiwary, learned APP for the State.
The petitioners, who are parents in law of the deceased, seek bail in anticipation of their arrest in connection with Hajipur Sadar P. S. Case No. 331 of 2019, dated 28.05.2019, instituted for the offences under Sections 304(B), 201 and 120 (B) of the Indian Penal Code.
The learned counsel for the petitioners has submitted that the deceased had married the son of the
Patna High Court CR. MISC. No.33590 of 2020(2) dt.12-03-2021 2/3 petitioners of her own volition and the petitioners were never consulted in the aforesaid marriage. In fact the petitioners are not at all concerned with the affairs of the deceased and her husband because of the fact that they had not maintained any relationship with the petitioners. The death, according to the information of the petitioners, is because of diarrhoea for which she was treated in the Heart and Diabetes Clinic at Hajipur from where she was referred to PMCH.
The husband of the deceased is in custody.
Considering the afore-stated facts, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with
Patna High Court CR. MISC. No.33590 of 2020(2) dt.12-03-2021 3/3 Hajipur Sadar P. S. Case No. 331 of 2019, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
The application stands allowed.
