Petitioner is accused in connection with Ara Nawada P.S. Case No. 357 of 2015 registered under Sections 376/511 of the I.P.C.

The accusation is of entering in the rented house of the informant and making attempt to commit rape at his daughter, Guria Kumari aged about 19 year with assurance to perform marriage, but on raising alarm, petitioner fled away. Learned counsel appearing on behalf of the petitioner submits that in fact, the informant is tenant of the petitioner and due to demand of two months due rent, the informant got managed to lodge this present case with false

Patna High Court Cr.Misc. No.2129 of 2016 (3) dt.10-03-2016 2/2 allegation of attempt to rape. In course of investigation, independent witnesses in paragraph nos. 18, 19, 43, 44 and 45 have stated about lodging the present case due to demand of due rent. Moreover, petitioner has no criminal antecedent and is in custody since 21.09.2015.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhojpur, Ara in connection with Ara Nawada P.S. Case No. 357 of 2015.
