JUSTICE MUNGESHWAR SAHOO ORAL ORDER 20-02-2015 Heard the learned counsel for the petitioner and the learned A.P.P. on behalf of the State.

The petitioner, Awadhesh Kumar, who is in custody since 7.7.2014 in connection with Raxaul P.S. Case No.155 of 2014 registered for the offence punishable under Section 387 of the I.P.C.

According to the prosecution case, 10 lakhs money was demanded form the informant, namely, Gaytri Devi through mobile No.8252691353.

The learned counsel for the petitioner submitted that this mobile belong to one co-accused, Pappu Kumar. The petitioner has been arrested only he was a room partner residing with that

Considering the above facts and circumstances of the case and the fact that the mobile through which money was demanded belong to co-accused, I direct that the above named petitioner be released on bail on furnishing bail bond of Rs.5,000/- (five thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran in connection with Raxaul P.S. Case No.155 of 2014.
