JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-01-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report but it is admitted case of the informant that he is not an eye witness of the alleged occurrence and there was land dispute between informant and the petitioners, who happen to be his agnates. In course of the investigation, not a single prosecution witness claimed himself to be an eye witness of the alleged occurrence and almost all the witnesses stated only to the extent that due to land dispute petitioners had given threatening to kill the deceased prior to the alleged occurrence.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.955 of 2016 (2) dt.11-01-2016 2/2 well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Bhagalpur in connection with Sanhaula P.S.Case No.58 of 2015.
