The petitioner is languishing in custody since 11.02.2015 in a case registered for the offences punishable under Sections 304 (B), and 201/34 of I.P.C. read with Sections 3/5 of Dowry Prohibition Act.

The prosecution case is that on 02.10.2014, a written complaint was made before Officer Incharge of the concerned police station by brother of the victim lady, who happens to be the wife of the petitioner, being subjected to cruelty by in-laws due to non fulfillment of their dowry demand and killed by them. Patna High Court Cr.Misc. No.16029 of 2015 (3) dt.27-08-2015 2/2 petitioner that the marriage was solemnized in the year 1991 and they were blessed with two sons, who are now 15 and 11 years old, respectively and the deceased lady, wife of the petitioner was residing in her Naihar.

However, from the paras 41 and 42 of the case diary, it appears that the case has been supported by two independent witnesses.

Under such circumstances, I am not inclined to grant bail to the petitioners. However, the petitioners may renew his prayer at the stage of trial, as it is hoped that trial will commence and conclude within a year.
