Versus

The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Vivekanand Vivek, Advocate For the Opposite Party/s : Mr. Md.Nazir Ansari (App) ====================================================== CORAM: HONOURABLE MR. JUSTICE AKHILESH CHANDRA ORAL ORDER 07-01-2015 Heard.

This is second attempt on behalf of the petitioner, whose prayer was earlier refused on 30.10.2012 in Cr. Misc. No. 31492 of 2012. Perused the report received from the trial court through letter no. 69 dated 18th December 2014 indicating keeping the trial pending awaiting FSL report and examination of another I.O. and further anticipating its conclusion within a period of six months. However, as submitted, it appears a bit excessive.

In view of the above, I find no reason to change the view already taken vide order aforementioned. Accordingly, the prayer for regular bail of the abovenamed petitioner, in connection with Sessions Trial No. 88 of 2013 arising out of Mojahidpur P.S. Case No.16 of 2012 pending before 6th Additional District Judge, Bhagalpur, is hereby refused. Simultaneously, the trial court is directed to conclude the trial within a period of three months from the date of communication of the order. (Akhilesh Chandra, J) Ashwini/- U T
