KUMAR ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 08-12-2020 Petitioner has prayed for the following relief(s): "(i) For necessary direction upon the respondent authorities to take stern action to stop the use of expired medicine in the Govt. Hospitals inasmuch as the Petitioner has come through several news reports that expired medicines are being supplied by the drug mafia in the Govt. Hospitals, which has got serious implication on the health of the general public.
Patna High Court CWJC No.10144 of 2017 dt.08-12-2020 2/3 ii) For necessary direction upon the respondent authorities to take necessary action against the officials and employees responsible for supply of proper medicines in the Govt. hospitals inasmuch as due to the complicity of the Govt. officials involved in supply of medicines and its storage in the Govt. hospitals either expired medicines are being provided to the Govt. hospitals or the medicines meant for the general public are being sold in open market, resulting into medicine scam.
(iii) For necessary direction upon the respondent authorities to develop such mechanism in the supply and storage of medicines so that the medicines meant for the general public may not be sold in the open market and it may reach to the genuine patients.
(iv) For necessary direction upon the respondent authorities to ensure that only Pharmacist shall look after the storage and dispensing of medicine in various Govt.
hospitals in Bihar inasmuch as it is seen that at various places, the persons other than Pharmacists have been engaged for the purpose of storage and dispensing of medicines.
(v) For any other direction, which your Lordships may deem fit and proper in the facts and circumstances of the case."
We find that with the passage of time the present petition has outlived its purpose and has become infructuous
Patna High Court CWJC No.10144 of 2017 dt.08-12-2020 3/3 inasmuch as the relief prayed for stands redressed as also on account of the efforts put in by the concerned authorities and constant monitoring of the issue by this Court. With the passage of time, the scope of the petition was expanded in relation to which, matter is now being monitored in a separate petition.
The order dated 28th of August, 2020 reflects that this Court had taken up an additional issue of filling up of all the posts of Doctors in Bihar.
As such, we dispose of the present petition reserving liberty to the writ petitioner to invite attention of the authorities to the remaining grievances, if any, as also approach the Court, if so advised, required and desired by way of a separate petition.
Interlocutory application, if any, shall also stand disposed of.
